Profile of the Case

Regal Lloyds International Real Estate Consultants Co., Ltd. (hereafter referred to as “Regal Lloyds”) is an excellent enterprise established in 2003 as a professional brainpower consulting organization with unique perspective and creative thinking in China’s urban development.

During the almost 20 years since its establishment, Regal Lloyds has been always endeavored to become the best urban development think tank in China to provide smart solutions for China’s urban development, help clients achieve excellence based on success, and improve urban development.

In order to better protect the brand, since 2017, it has cooperated with Yajia to systemize its major brand and subsidiary brands.

The brand protection scheme is finally formed based on the analysis that 80 trademarks of different areas were registered with possible legal risks in the future analyzed carefully and solutions made in advance to deal with the accidents during trademark application.

During the first half of 2019, there were 16 cases rejected, which were as we formerly predicted upon application.

Therefore, with new conditions taken into consideration, we soon adjusted according to the countermeasures made upon estimation, wrote reason letters for all the re-reviews in time, and submitted the legal documents for the re-reviews of the 16 rejected trademarks within re-review term after rejection.

Yajia’s Opinion

The 16 cases differ due to their different goods or services, but there are things in common, and this article is only to introduce the thinking way of re-reviewing their common points.

Major thinking way of re-review:

1.The element of mark in the associate mark to function as the core to be distinguished is in Chinese language;

2.The reviewed logo obviously differs from the quoted logo in general appearance, call, and meaning;

3.Letter is the design element of both logos, and the key for the comparison between the reviewed and quoted logos shall be the visual feeling brought by the general appearance to consumers.

Centering on the three cores, Yajia detailed the 16 cases and quoted previous successful cases. 

Re-review Result

All the 16 rejected trademark were supported by the Trademark Review and Adjudication Board, and the registration of all the trademarks rejected by the Trademark Office was approved.
